This End User License Agreement (hereinafter "this EULA") is a legal agreement between you and catoocraft LLC (hereinafter "the Company") concerning your use of the mobile application "Memotto mp" (hereinafter "the App").
The Company grants you a non-exclusive, non-transferable license to use the App for personal and non-commercial purposes, subject to the terms and conditions of this EULA.
All copyrights and other intellectual property rights related to the App belong to the Company or a third party who has granted a license to the Company.
You shall not, in using the App, perform any of the following acts:
The Company makes no guarantee regarding the completeness, accuracy, or safety of the App's operation. The Company shall not be liable for any damages incurred by you as a result of using or being unable to use the App.
The health management features of the App (recording of body temperature, blood pressure, blood oxygen levels, etc.) are intended for users to manually enter, record, and manage data. The App is not a medical device and is not intended for medical diagnosis, advice, treatment, or prevention.
The App does not have measuring functions and does not make any medical judgments based on recorded data. If you have concerns about your health or require medical judgment, always consult a physician or healthcare professional. The Company is not responsible for any actions taken by the user based on the records in this App.
The App provides a feature to save data to your own Google Drive, but the Company is not responsible for the terms of use, security, or data loss related to Google Drive.
The App provides a voice recognition feature for input assistance; however, the Company makes no guarantee regarding its accuracy. Users must always verify the values entered via voice recognition and manually correct them if there are any errors. The Company shall not be liable for any damages resulting from errors in voice recognition.
1. The App offers paid subscriptions (hereinafter "Subscriptions") that provide additional features, such as the removal of advertisements.
2. Payment and Renewal: Payment for Subscriptions will be charged to your Google Play Store or App Store account (hereinafter "Store Account") at the time of purchase confirmation. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
3. Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of the renewal will be identified.
4. Managing and Canceling Subscriptions: You can manage your Subscriptions and turn off auto-renewal by going to the Google Play Store or App Store settings after purchase. Cancellations cannot be processed within the App or by contacting the Company directly.
5. Refunds: No refunds will be provided on a pro-rata basis even if you cancel during a paid period. Any requests for refunds related to payments must be made to the respective platform provider (Apple Inc. or Google LLC) in accordance with their terms and conditions.
The formation, validity, interpretation, and performance of this EULA shall be governed by the laws of Japan. All disputes concerning this EULA shall be subject to the exclusive jurisdiction of the Kobe District Court, which has jurisdiction over the location of the Company's headquarters, as the court of first instance.
The Company may modify this EULA as necessary. The modified EULA shall take effect from the time it is published on the App or on the Company's website. By continuing to use the App after the modification of this EULA, you are deemed to have agreed to the changes.
